  • Essay / Justice must be done. Treating Minors Equally to Adults

“While this is not the biggest scandal in American legal history, many are calling it at least the darkest day for the nation’s troubled juvenile justice system” (Ken Stier) . Since the creation of juvenile court, many people believed that juveniles should be tried as adults. In the 1990s, juveniles who broke the law were treated like adult offenders. Juveniles who commit crimes are more likely to escape charges because their brains are not fully developed. Due to the facts and evidence that the United States has established regarding juveniles, juveniles should further be tried as adults and serve time for the crime they committed. Many Americans agree that juveniles who commit serious crimes should be tried as adults, and face consequences. “Juveniles fourteen years of age or older charged with committing certain types of serial murder or sexual offenses, under Proposition 21, are generally no longer eligible to appear in juvenile court and prosecutors are authorized to bring direct complaint against juvenile delinquents in adult court..." (California Proposition 21). In many circumstances, juveniles commit certain types of crimes at a very young age and should be tried as adults, simply because the fact that their teenagers commit crimes does not mean that they did not know what they did. Many young teenagers are released for the crime they commit and should not be released just because their losing brain tissue does not mean they do not realize what they are doing at that time. “Under Proposition 21, probation departments do not have discretion to determine whether juveniles arrested for any of more than 30 specific serious or violent crimes should be released or detained; instead, Proposition 21 makes detention mandatory under those defined...... middle of document ......d States, juveniles accused of violent crimes should be treated as adults in the system of criminal justice” (Maxwell). In the criminal justice system, everyone has the right to be treated equally, regardless of their age. This society we live in believes that many young offenders are treated differently depending on their age and that their brains are not fully developed. It is an injustice that the court has the right to treat minors the same as an adult. There should be a reaction or action against juveniles who commit certain types of crimes, furthermore they should receive their punishment for what they did and judged as adults. In the United States, many people believe that juveniles should be tried as adults, and with evidence and facts, it has come to a point that they should be treated the same regardless of their age..
