  • Essay / The 2nd Amendment to the United States Constitution

States tend to pass laws that promote public safety. Laws passed after mass shootings typically aim to strengthen gun control. They can also spark much debate among those who question the constitutionality of the laws. The argument usually comes down to the Second Amendment giving citizens the right to bear arms. However, the wording of the amendment leads some to misinterpret what is actually being granted to the people. Anti-2nd Amendment laws do not actually violate the amendment itself because it only grants the right to own guns, the laws only place limits on gun ownership, and the laws are for safety of the public. The language of the Second Amendment only says that the right to bear arms shall not be infringed; therefore, placing restrictions on gun ownership does not violate the Second Amendment. Many people try to claim that they are guaranteed to always have guns and are under no restrictions on what they can own, citing the Second Amendment as proof. This is not the case, because the amendment does not explicitly state that restrictions cannot be placed on gun ownership; it only removes the power to ban all gun ownership in the United States. The ruling that the Second Amendment does not protect citizens in all cases was upheld in United States v. Miller, where the court ruled that charging Jack Miller with carrying a firearm unregistered fire was actually legal under the Second Amendment. The decision was made because there was no evidence demonstrating that a firearm with a barrel less than eighteen inches had any connection to the preservation of a regulated militia (UNITED STATES v. MILLER et al.). The precedent set by this case shows how gun control laws can exist without violation...... middle of document ...... carefully examined, it reveals that nowhere does it say that Everyone has the right to carry whatever weapons they want, wherever they want. The law simply makes it illegal to completely take away the right to bear arms. Therefore, gun control laws that some believe violate the Second Amendment actually respect it because they do not take away rights and protect the public from potential harm. NRAILA RSS.
